Does the ADA Apply to Your Website?
Who it covers
The ADA applies to two main areas. Title III covers private businesses open to the public, such as retail, hospitality, healthcare, banking, and education. Title II covers state and local government. Most commercial websites answer to Title III.
Which standard applies
The technical standards also differ. Title II sets WCAG 2.1 Level AA, while Title III does not set a specific technical standard. Our check tests WCAG 2.2, which includes all of WCAG 2.1 plus additional requirements.
The date that matters
Title III has been in force for a long time. Title II now has two deadlines: 26 April 2027 for public entities serving 50,000 people or more, and 26 April 2028 for smaller ones.
Who enforces it
The Department of Justice can take action, but most website accessibility cases are brought privately. Federal ADA claims can lead to court orders and legal costs. Financial damages may come from state laws like California's Unruh Act and New York's Human Rights Law.
What does the free ADA check cover?
The free check tests your homepage against WCAG 2.2 Level AA, the newest version of the guidelines. It includes WCAG 2.1, the standard named in the ADA, plus additional requirements.
You get your compliance status, with the count of every issue found graded critical, high, medium or low. With the full report sent by email, you also get a breakdown of which disability groups those issues affect, and which of the four WCAG principles is weakest. No account, no card.
What to Do With Your Results?
The full report shows how many issues you have, their severity, who they affect, and which WCAG principles need attention.
What you do next depends on which result you got:
Compliant. Congratulations! That's rare on a first scan. Run a full scan to check your whole site, then turn on continuous monitoring to catch future changes. Our advanced tools can also check colour contrast, tabbing order and content.
Partially compliant. You've got a mix of good and bad. Work through the flagged issues using our Content and Media tools, then run the check again to confirm they're fixed. Once the check comes back compliant, you're ready for a full website scan.
Non-compliant. Start with critical and high-severity issues. Because they often come from repeated components, fixing one can resolve several issues at once. Run the check again, or let our team help with the remaining issues.

For private businesses, the ADA does not name a specific WCAG version for websites. However, WCAG Level AA is widely used as the technical benchmark. For state and local government, the US Department of Justice names WCAG 2.1 Level AA. This check tests WCAG 2.2, which the W3C confirms also conforms to 2.1 and 2.0.
